We need your help to improve the draft agreement: Our School Uses Creative Commons Policy

Our School Uses Creative Commons Policy

Consent of this agreement supports the principles and values of sharing, changing, exchanging, learning and benefiting from Open Educational Resources (OER) by using Creative Commons licences.

This licensing agreement provides permission for educators to reuse, redistribute, revise, and remix materials while acknowledging the intellectual property and attribution rights of the original creator.

Our school ______________________________________ (name of school)

  • asserts copyright[1] over resources created within our school and transfers copyright where possible to the resource creator where a free content licence is used.
  • adopts the following as default licence to all resources wherever possible:

(delete or cross out one, as appropriate)

Creative Commons Attribution 3.0 New Zealand Licence (CC-BY)

Creative Commons Attribution Share Alike 3.0 New Zealand Licence (CC BY-SA)

  • agrees that unless otherwise stated in contractual obligations in an employment agreement all resources created will be licensed under the default licence.
  • will attribute resources to its copyright holder and share resources under the conditions stipulated under the default licence.
  • will endeavour to wherever practicable clearly label resources with the appropriate Creative Commons symbol. For reference: http://www.creativecommons.org.nz

Copyright works not exclusively owned by our school

The exceptions to our Creative Commons policy are as follows:

  • Co-ownership refers to materials that are jointly owned by the school and a staff member as identified within the employment agreement. The licensing for reuse of these resources requires specific agreement from the co-owners, but we encourage the parties to consider Creative Commons Licences.
  • Exclusive Ownership refers to materials created by a school employee when a school has specifically commissioned work such as the creation of marketing or advertising materials. This is again indentified within an employment contract and the licensing for reuse requires specific agreement from the exclusive owner. But we encourage the parties to consider Creative Commons Licences.
  • Ownership by a Third Party refers to work that is undertaken by an external party and is managed by contractual arrangements. These contractual arrangements will establish copyright and licensing requirements in advance of the work being undertaken. The licensing for reuse of these resources requires specific agreement with the contract.
  • Students Work. Our school does not make any claim over the ownership of students’ work.
