Bangladesh take series with tight win

Bangladesh 276 for 7 (Shakib 65, Ashraful 64) beat West Indies 274 for 5 (Dowlin 100*, Smith 44) by three wickets

Every time they step on the field, Bangladesh seem to be making history. After having beaten West Indies for the first time in Tests and ODIs, they today sealed their first ODI series win against the hosts. More importantly, this win came by way of their highest successful chase in the limited-overs format, reaching the requisite 275 with six balls to spare.

At the centre of the accomplishment once again was Shakib Al Hasan, pulling West Indies back from a flying start, and then seeing his team through a tricky chase with a calm 65. Mohammad Ashraful, who got to back-to-back fifties for the first time since 2006, set up the Bangladesh reply after the openers struggled on a sluggish pitch that made it difficult to stroke the ball cleanly. The Shakib-Ashraful combination outdid an exceptional effort from Travis Dowlin, whose maiden international century lifted a fledgling West Indies to a fighting total.

Ashraful and Shakib came together after a sensible third-wicket partnership between Ashraful and Raqibul Hasan had ended, thanks to the pressure created by a slow pitch and tight bowling. Nevertheless, they had added 52 after the openers fell in a quick succession.

It was here that Ashraful took the lead, not letting the pressure mount. He first made room and slashed Bernard in the 28th over for the first boundary in 70 balls. When Rawl Lewis replaced Bernard in the next over, Ashraful lofted him over long-off for a six, bringing up his second fifty in three days. Shakib joined him in that charge, sweeping both Lewis and Bernard over midwicket. Those three overs brought Bangladesh 32 runs, and also brought down the asking-rate to less than six.

When Ashraful went for another six off Lewis, he put his team in a tricky state again, holing out to long-off. Until then, his 77-ball 64 had been well-paced, and he had added 74 with Shakib in 63 deliveries. But with 85 still required, Shakib had a major role to play. The boundaries were not easy to come - even Lewis negated the big sweep with googlies and straighter ones - but Shakib ran purposefully. He had to run all but six of his last 50 runs, but hardly did he ever let the scoring-rate fall.

During the match, the cameras panned to a spectator reading a magazine article on Shakib, titled the "Ice Man". Shakib indeed played like one, but needed some luck on his side. With 71 required off 60, Shakib tried to hit Lewis out of the ground, only skying it to land perfectly between cover and long-off, which also resulted in a collision between Darren Sammy and Bernard. That shot also took Shakib to his half-century, kicking off a spell of ordinary cricket from both sides.

With 56 needed off the last eight overs, Shakib called for the batting Powerplay, and Roach immediately threatened to finish the match in a hurry. Even before he could do that, Floyd Reifer almost let him bowl with five fielders outside the circle. Roach started with a half-volley and a fulltoss both hit for boundaries, before bowling his second beamer of the match to be removed from the attack. What's more, Shakib deposited it for a six.

Now it was the Ice Man's turn to falter with the match almost pocketed. He swung across the line to Sammy, getting out with 37 needed off 41. Three wides came in the next two overs before Bangladesh contributed their bit to the chaos. Devon Thomas, the designated wicketkeeper, had to bowl what was left of Roach's overs, and Mahmudullah gifted his second delivery with a leading edge. Riefer brought the fine leg up, Thomas saw two of his straight deliveries being punished and bowled two off-side wides to compensate. Mushfiqur returned the favour by hitting a fulltoss straight to cover. During that surreal period, the only question was which team wanted to lose more badly.

An overthrow here, an edge there, and Bangladesh reached the series win with an outside-edged boundary by Abdur Razzak. During this period of drama, the turnaround earlier in the day was almost forgotten.

For the majority of the first innings, both Dowlin and West Indies seemed to struggle to get the ball off the square against the spinners. West Indies had huffed and puffed their way to 176 for 4 in 40 overs, struggling to combat the grip and the turn. Dowlin's story was no different - he took 88 deliveries to reach his fifty and had trouble with his running between the wickets, too.

But with the Powerplay taken in the 41st over, things changed. Dowlin slog-swept the spinners with vengeance, getting close to the pitch every time, and hitting to long-on, cow corner, midwicket, square leg, et al. By the end of the Powerplay, West Indies had reached 216 for 5, and Dowlin 87 off 105 deliveries. In the next five overs, Dowlin took little time to reach his maiden century, and Lewis and Sammy made sure West Indies finished with 98 runs in their last ten overs. In the end, though, they were to be second-best.

Downpour halts life

Staff Correspondent: Incessant rain overnight had much of the city knee-deep in water throughout the day yesterday, wreaking havoc on life and trade.

At least nine people were killed and many injured as they stepped on power cables that had shorted in the driving rain.

The met office said 290 millimetres of rain fell in six hours to 7:00am. It is a record six-hour rainfall for the capital in 60 years.

The country's highest rainfall in 24 hours to 7:00am was 333mm in Dhaka. The second highest was recorded in Mongla at 169mm.

Meteorologists said a low formed in the Bay joined forces with monsoon clouds and created a unique condition that caused such extraordinary rainfall.

They forecast the intensity will come down today, but the rain spell might continue till tomorrow.

The torrential pouring started at around 10 on Monday night. It soon submerged the city streets and alleyways, leaving hundreds of commuters stranded on their way back home.

With high winds and thunder, it snapped power and phone lines and making roads and sidewalks even more dangerous for late-night commuters.

People in the shantytowns were the worst sufferers. They found their huts under knee-deep water by 3:00am and had to take shelter in nearby buildings.

Most of those living on ground floors had to spend a sleepless night as they saw water reach for their beds.

Attendance at the government and private offices was very thin. Shopping malls and other businesses had few shoppers as people remained indoors.

Children in most areas could not go to schools.

Though it meant sufferings for the downscale urbanites, the rain ended long dry spells bordering on drought, much to the relief of the farmers.

Of those who contacted live power lines, seven including a woman and a baby girl were in the capital and the rest two in Nalitabari upazila of Sherpur.

Shafiqul Islam, 35, and six-year-old Bristi died in the city's Kafrul area, Abdul Kader, 28, in Fakirapul, Jannatul Mawa, 35, in Demra, Shahin in Mohammadpur and Bahar Uddin, 22, in South Kamalapur and Delwar Hossain, 30, in Jatrabari.

News Agency UNB reports that the Nalitabari victims are Azizul Haque, 55, and Muktarunnesa, 65. The two hailed from Haluaghat upazila in Mymensingh district.

As it poured all night the spectre of the floods that devastated Dhaka in 1988 and 1998 haunted the city dwellers.

Many commuters had to spend the night outside home as their vehicles could not reach destinations.

“I spent the night at a garage,” said a newspaper reporter who lives in Katashur.

“As the CNG taking me home got on Dhanmondi Road-27, water leapt up to the seats. Shortly afterwards the engine stopped forcing me to take refuge at the garage in a roadside building,” he added.

Most of the main thoroughfares including Manik Mia Avenue, Bijoy Sarani, Darus Salam Road, Airport Road, Rokeya Sarani, Mirpur-1, Mirpur Road, Outer Circular Road, Bijoy Nagar and the road in front of the Prime Minister's Office reeled under knee-to-waist-deep water for hours.

Passengers of the CNG-run auto-rickshaws had a terrible time as the three-wheelers stopped running without notice.

The rickshaws and auto-rickshaws that braved rainwater in the morning charged many times the usual fares.

Saiful Islam, a private firm employee, said it cost him Tk 200 to come to his office at Karwan Bazar from Mouchak.

Liton Ali of Kazipara in Mirpur said rickshaw-pullers charged Tk 50 for a ride that usually takes around Tk 5.

The manholes or potholes added to the sufferings as vehicles and pedestrians stumbled on them and fell in water.

Flights Cancelled Two international flights--one of Malaysian Airlines from Kuala Lumpur and the other of Dragon Airlines from Hong Kong--failed to land at Zia International Airport Monday night because of rain.

"The Malaysian flight is scheduled to fly in again tonight," said an official from ZIA yesterday evening.

Other flights however left the airport and landed there on schedule, he added.

Bus and Ferry Services Disrupted Hundreds of motorised vehicles, including CNG-run auto-rickshaws, taxicabs and private cars, were stranded on the waterlogged roads for hours as their engines went out of order.

Meanwhile, only a small number of buses, trucks and auto-rickshaws came out on the roads yesterday, causing sufferings to those venturing out.

Besides, buses running between the capital and Mymensingh, Sirajganj and Tangail had to opt for Gabtoli road instead of the inundated Airport Road.

Ferry services on many routes were also suspended, disrupting bus service on highways.

Operation of launches and speedboats along Mawa-Kawrakandi route remained suspended for inclement weather.

Besides, over 500 vehicles were stranded on both ghats, as ferries were taking three to four hours more than what they normally take to cross the Padma.

Other Districts Our correspondents from different districts including Barisal, Khulna, Bagerhat Satkhira, Pabna, Sylhet, Chittagong, Manikganj and Noakhali dispatched similar stories.

They said many thatched and mud houses caved in and the flimsy ones got blown away. Many areas plunged into darkness as electricity went out due to heavy rains.

Our Chittagong correspondent reports: Life in the port city came to a halt due to ceaseless rain.

Loading and unloading of cargoes were suspended at the port.

According to the Met office, over 156mm rainfall was recorded in Chittagong city in 24 hours to 4:00pm yesterday.

Loading of bulk cargoes has remained suspended at different jetties and the outer anchorage in the port area for the last two days due to rain, said port officials.

Vessel operation on the port channel however continued, said Chittagong Port Secretary Syed Farhad Uddin Ahmad.

Reclaiming of some city canals by the Chittagong City Corporation seemed to have prevented situation getting worse in rains.

People in low-lying areas like Muradpur, Bahodderhat, Nasirabad, Badurtala, Agrabad CDA residential area, Agrabad Excess Road and Halishahar however still had to face waterlogging.

DND Embankment The low-lying areas inside Dhaka-Narayanganj-Demra (DND) and Narayanganj-Narsinghdi embankments have been inundated due to incessant rain, paralysing the life of several thousand people.

Many schools inside DND remained closed and production at most of the 1,000 industrial units suspended.

The water level in Shitalakhya, Meghna, Brahmaputra and Dhaleswari rivers continued to rise. The district administration apprehended that if rain continues for next two to three days, the water level would go past the danger mark.

At least 300 houses and 400 shops and go-downs in a market inside Narayanganj-Narsinghdi dyke in Rupganj have gone under water causing a loss of several crores of taka.

Joynal Abedin, a resident of the area, said construction of five culverts on the link road was scheduled to be completed by January. But that did not happen, leading to waterlogging inside DND area.

Misery rains down on city slums

Pinaki Roy: It was 2:30 am Tuesday. An unbroken spell of rain was creating a rhythm on the corrugated tin roof of their room. The night would have been otherwise good for deep sleep. But the poor couple--Md Farhad and Jamila along with their three children--were sitting on their small cot with water rolling into the room.

Rain started at about 10:00pm. Jamila brought their four hens inside the room as the small yard was already under knee-deep water.

Five members of the family live in the room -- 10 feet by 10 feet or so. The couple along with their one-year old daughter Beauty used to sleep on the floor, and their two sons-- Imran and Raihan-- on the cot. Normally rainwater does not enter the room but the situation was quite different this time.

Jamila bundled their beddings, put those on one side of their cot and anxiously waited for the water to recede.

Several hundred stranded Pakistanis are staying at this camp in Mirpur Section-11, near the journalists colony. It is one of the densely populated slums in the capital.

The plight of all those living at the camp was similar to that of the family of Farhad and Jamila. Many were shouting to draw others' attention in efforts to find a way out, and children were crying, said Farhad describing the situation to this correspondent yesterday.

“It seemed to be 'keyamat' (doomsday). I never saw such rains in my life,” he said.

"At one stage, we found all our utensils and other household goods floating in rainwater inside our room. I told my wife we have to move from here. And I tried to see what others were doing,” Farhad recalled.

It was almost waist-deep water on the adjacent road and garbage was afloat there. There is a four-storey old building inside the camp but it was already over crowded. Many people already took shelter there, he said.

As the situation continued to worsen, Farhad crossed the road and started banging the door at a flat in the journalists colony. This is the only place nearby where they could seek shelter. Jewel Mia, Shamsur and some others also joined him.

But the ground floor of that building was also submerged. So, they had to stay on the stairs of the building, said Farhad. “We spent the whole night standing there.”

Most of the slum dwellers in Mripur, Pallabi, Rupnagar and other areas of the city faced the same situation.

People living in slums beside Rupnagar canal were among the worst sufferers. Rainwater from Rupnagar and Pallabi flows out through this canal. So, their shanties went under water much before those in other slums.

The slum dwellers have taken refuge in different houses, schools and colleges in Mirpur area.

“We could not take out anything. All our clothes, utensils and food are under water now,” said a rickshaw puller staying at a college in Rupnagar. Many others have also shifted to this college.

Local people collected money and bought bitten rice for them yesterday afternoon, which was their first meal in the day.

সেনা আইনে বিচার, তবে পরামর্শ নেওয়া হবে সুপ্রিম কোর্টের

আহমেদ দীপু: সেনা আইনে বিডিআর বিদ্রোহের বিচার হবে, তবে বিচার প্রক্রিয়া যাতে বাধাগ্রস্ত না হয় সেজন্য সুপ্রিম কোর্টের কাছে পরামর্শ নেওয়া হবে। আগামী এক সপ্তাহের মধ্যে সংবিধানের ১০৬ অনুচ্ছেদ অনুযায়ী রাষ্ট্রপতির পক্ষ থেকে সুপ্রিম কোর্টের কাছে পরামর্শ চেয়ে আইন মন্ত্রণালয় থেকে চিঠি পাঠানো হবে। ১৫ আগস্টের আগেই সরকারের পক্ষ থেকে এ বিষয়ে আনুষ্ঠানিক ঘোষণা দেওয়া হবে।
গতকাল সোমবার স্বরাষ্ট্র মন্ত্রণালয়ের সভাকক্ষে অনুষ্ঠিত আন্তঃমন্ত্রণালয় সভায় এসব বিষয়ে মতৈক্য হয়। কোন আইনে বিডিআর বিদ্রোহের বিচার হবে তা চূড়ান্ত করার লক্ষ্যে এই সভা বসে বিকেল সাড়ে ৪টায়। বৈঠক শেষে আইন, বিচার ও সংসদ বিষয়ক মন্ত্রী ব্যারিস্টার শফিক আহমেদ সাংবাদিকদের বলেন, বিচারের স্বচ্ছতা নিশ্চিত করার জন্য সুপ্রিম কোর্টের আপিল বিভাগের কাছে পরামর্শ চাওয়া হবে। তিনি বলেন, ৩টি আইন নিয়ে আলোচনা হয়েছে। এখন সুপ্রিম কোর্ট যে আইনে বিচার করতে বলবেন সে আইনেই বিডিআর বিদ্রোহের বিচার হবে। মন্ত্রী বলেন, সংবিধানের ১০৬ অনুচ্ছেদ অনুযায়ী রাষ্ট্রপতির পক্ষে সরকার সুপ্রিম কোর্টের কাছে এ বিষয়ে পরামর্শ চাইবে।
আইনমন্ত্রী বৈঠকের শেষ দিকে বিষয়টি নিয়ে টেলিফোনে প্রধানমন্ত্রীর সঙ্গে কথা বলেন। এরপর তিনি সাংবাদিকদের সামনে সরকারের সিদ্ধান্তের কথা তুলে ধরেন।
বৈঠকে উপস্থিত একাধিক সূত্র জানিয়েছে, বিদ্রোহ এবং হত্যা, লুটপাট, অগি্নসংযোগ এবং নির্যাতনের সঙ্গে জড়িতদের বিরুদ্ধে সেনা আইনে সর্বোচ্চ সাজা দেওয়া হবে। আর যারা শুধু বিদ্রোহের সঙ্গে জড়িত তাদের সর্বোচ্চ ৭ বছরের সাজা দেওয়া হবে। এজন্য ইতিমধ্যেই অপরাধী বিডিআর সদস্যদের দুই ভাগে ভাগ করার কাজ শুরু হয়েছে। সেনা আইনের ৫ নম্বর ধারা অনুযায়ী বিচার শুরুর আগে সরকারের পক্ষে প্রতিরক্ষা মন্ত্রণালয় গেজেট প্রকাশ করে ডিসিপ্লিন ফোর্স হিসেবে বিদ্রোহী বিডিআর সদস্যদের বিচারের জন্য সেনা আইনের আওতায় নিয়ে আসবে। সেনা আইনের আওতায় বিচার হলেও বিদ্রোহের সময় সংঘটিত অপরাধের জন্য ফৌজদারি কার্যবিধি অনুযায়ী অপরাধীর যেসব সুযোগ পাওয়ার কথা তার সবই নিশ্চিত করা হবে।
বৈঠকে বলা হয়, বিডিআর বিদ্রোহ এবং পিলখানায় ঘটে যাওয়া ঘটনার বিচার সেনা আইন এবং প্রচলিত আইনেও হতে পারে। তবে যেহেতু এ ঘটনায় একটি ডিসিপ্লিন ফোর্স অন্য একটি ফোর্সের ৫৭ জন্য কর্মকর্তাকে হত্যা এবং তাদের সম্পদ লুটপাট, অগি্নসংযোগের মাধ্যমে ক্ষতিসাধন করেছে, কাজেই তাদের বিচার সেনা আইনে হওয়া উচিত। অন্য কোনো আইনে বিচার করতে গেলে নানা ধরনের সমস্যা হতে পারে। বিশেষ করে এ ঘটনায় ক্ষতিগ্রস্তরা নতুন করে বিব্রতকর পরিস্থিতির মুখোমুখি হতে পারেন। এ সময় বলা হয়, বিদ্রোহের ঘটনায় দায়েরকৃত মামলাগুলো প্রচলিত আইনের আওতায় বিচারের জন্য আদালতে উঠবে। এরপর বিচারক বিডিআরের ঊর্ধ্বতন কর্মকর্তাদের কাছে জানতে চাইবেন তারা কোন আইনে এসব ঘটনার বিচার চান। তখন সেনা আইনে বিচারের জন্য বিডিআরের পক্ষ থেকে আদালতের কাছে আবেদন করে মামলাগুলো স্থানান্তর করা হবে।
সূত্রটি জানায়, সেনা আইনে বিদ্রোহের জন্য সর্বোচ্চ শাস্তি মৃত্যুদণ্ড। তবে এক্ষেত্রে বিদ্রোহের সঙ্গে জড়িত সবাইকে মৃত্যুদণ্ড দেওয়া হবে না। বিডিআর আইন মাথায় রেখে শুধু বিদ্রোহের সঙ্গে জড়িতদের সেনা আইনে বিচার করা হবে। এক্ষেত্রে তাদের লঘু সাজা হিসেবে সর্বোচ্চ ৭ বছর সাজা দেওয়া হবে। প্রসঙ্গত, বিডিআর আইন অনুযায়ী শৃঙ্খলা ভঙ্গের দায়ে এর সদস্যদের বিরুদ্ধে সর্বোচ্চ ৭ বছরের সাজা দেওয়ার বিধান রয়েছে।
বাণিজ্যমন্ত্রী লে. কর্নেল (অব.) ফারুক খান এদিনের বৈঠকে প্রচলিত আইনে বিডিআর বিদ্রোহের বিচারের জন্য বক্তব্য দেওয়া শুরু করেন। কিন্তু প্রচলিত আইনে বিচার করতে গেলে কী সমস্যা হতে পারে সে বিষয়গুলো তুলে ধরা হলে তিনি পিছিয়ে আসেন। সূত্র জানায়, এ সময় বলা হয় প্রচলিত আইনে বিচার করতে গেলে মামলার কোনো সাক্ষী পাওয়া যাবে না। কারণ এ ঘটনায় হত্যাকাণ্ডের সাক্ষী হবেন বিডিআর সদস্য। একজন বিডিআর সদস্য আদালতে অপর বিডিআর সদস্যের বিপক্ষে সাক্ষী না দেওয়ার সম্ভাবনাই বেশি। এছাড়া লুটপাট, অগি্নসংযোগ এবং বিভিন্ন পরিবারের সদস্যদের ওপর যে নির্যাতন চালানো হয়েছে সে বিষয়গুলোও আদালতে নতুন করে উঠে আসবে, যা ক্ষতিগ্রস্ত সেনাবাহিনীর কর্মকর্তাদের পরিবারের পক্ষে খুবই কষ্টকর হবে। সেনা আইনে বিচারের জন্য এসব বিষয় বিবেচনায় নেওয়া হয়েছে।
বিডিআর আইনের বিষয় নিয়ে আলোচনার সময় বলা হয়, বিদ্রোহের মূল নায়ক হচ্ছে ডিএডি এবং ডিডিরা। তাদের বিচার বিডিআর আইনে করা যাবে না। কারণ ওই আইনে এসব পদের বিষয়ে কিছুই উল্লেখ নেই। কাজেই মূল নায়কদের বিচার করা সম্ভব না হলে বিদ্রোহের বিচার কোনোভাবেই সম্পূর্ণ হবে না। এছাড়া বিষয়টি আদালতে চ্যালেঞ্জ হতে পারে। এসব কারণে বৈঠকে উপস্থিত মন্ত্রী-প্রতিমন্ত্রী এবং সামরিক ও বেসামরিক কর্মকর্তারা তিনটি আইনের মধ্যে সেনা আইনে বিচারের পক্ষে একমত হয়েছেন। সেনা আইনে বিচার শুরু হলে যাতে বিষয়টি আদালতে চ্যালেঞ্জের মুখে না পড়ে সেজন্যই সুপ্রিম কোর্টের সঙ্গে পরামর্শ করে নেওয়ার সিদ্ধান্ত হয়। এই সভায় বিডিআরের মহাপরিচালক সেনা আইনে বিচারের পক্ষে লিখিত বক্তব্য তুলে ধরেন।
গত ২৫ ও ২৬ ফেব্রুয়ারি পিলখানায় বিডিআর বিদ্রোহের নামে উচ্ছৃঙ্খল বিডিআর সদস্যরা সেনাবাহিনীর ৫৭ কর্মকর্তাকে হত্যা করে। বিডিআরে কর্মরত সেনাবাহিনীর কর্মকর্তাদের বাড়িঘর লুটপাট, অগি্নসংযোগ এবং তাদের পরিবারের সদস্যদের ওপর নির্যাতন চালায়। পিলখানার ঘটনা পর্যায়ক্রমে সারাদেশের বিডিআর ক্যাম্পে ছড়িয়ে পড়ে। সরকার রাজনৈতিকভাবে মোকাবেলা করে পরিস্থিতি নিয়ন্ত্রণে নিয়ে আসে। ২৬ ফেব্রুয়ারি সন্ধ্যায় বিডিআর সদস্যরা অস্ত্র জমা দিয়ে আত্মসমর্পণ করে। বিদ্রোহের সঙ্গে জড়িত প্রায় তিন হাজার বিডিআরকে গ্রেফতার করা হয়েছে।
আইনমন্ত্রীর সভাপতিত্বে অনুষ্ঠিত সভায়, বাণিজ্যমন্ত্রী, আইন প্রতিমন্ত্রী, স্বরাষ্ট্র সচিব, আইন সচিব, অ্যাটর্নি জেনারেল, বিডিআরের মহাপরিচালক, বিডিআর প্রসিকিউশন দলের প্রধান এবং সেনাবাহিনীর কর্মকর্তারা উপস্থিত ছিলেন।
